1. Agreement to Terms

These Terms of Service ('Terms') are a legally binding agreement between you and Comik AI ('Company,' 'we,' 'our,' or 'us') governing your access to and use of our website, applications, AI image and video creation tools, asset library, subscriptions, credits, integrations, and related services (collectively, the 'Service'). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you are at least 18, have the legal capacity to enter into these Terms, and have authority to use any payment method, account, content, image, video, likeness, or reference material you submit.

3. Description of Service

Comik AI provides AI-powered creative tools for image and video creation, including:

  • Text-to-image, image-to-image, and reference-based image generation.
  • Text-to-video, image-to-video, and AI video generation workflows.
  • Character visual creation, story scene creation, animated content, and other creative media generation.
  • Prompt, style, model, and generation settings that help users guide creative outputs.
  • Asset library features for storing, viewing, downloading, favoriting, and managing generated images and videos.
  • Subscription plans, one-time offers, credits, promotions, and related account entitlements.
  • Optional third-party integrations, such as export or connection workflows.

The Service uses automated AI systems and third-party providers. Output quality, availability, similarity, accuracy, style consistency, generation speed, and model behavior are not guaranteed.

4. User Accounts

4.1 Account Registration

You may need an account to access certain features. You agree to:

  • Provide accurate, current, and complete information.
  • Keep your login credentials, sessions, and linked accounts secure.
  • Maintain a valid email address and promptly update account information when needed.
  • Accept responsibility for all activity under your account.
  • Use credits, subscriptions, promotions, and generated assets only in accordance with these Terms.
  • Not sell, rent, transfer, or share your account access in a way that abuses or circumvents the Service.

4.2 Account Security

You must notify us immediately at support@comik.ai if you believe your account, credentials, payment method, or generated assets have been accessed or used without authorization.

5. Acceptable Use Policy

5.1 Compliance with Laws and Rights

You are responsible for your prompts, uploads, reference materials, generated outputs, downloads, publishing, sharing, distribution, commercial use, and any other use of the Service. You must comply with all applicable laws, these Terms, our policies, third-party rights, and the terms of any third-party services you use with Comik AI.

5.2 Prohibited Content and Conduct

You agree NOT to use the Service to create, upload, request, generate, store, share, or distribute content or conduct that:

  • Is illegal, fraudulent, deceptive, harmful, abusive, harassing, defamatory, or invasive of privacy.
  • Sexualizes, exploits, abuses, endangers, or depicts minors in any sexual or exploitative manner, including stylized, illustrated, anime, or fictional depictions.
  • Creates or requests non-consensual sexual content, intimate imagery, sexual deepfakes, or content involving a real person's likeness without lawful authority.
  • Promotes hate, harassment, threats, self-harm, violent extremism, or graphic violence.
  • Infringes or misappropriates copyrights, trademarks, trade secrets, publicity rights, privacy rights, rights in fictional characters, brand rights, celebrity likeness rights, or other third-party rights.
  • Uses images, videos, characters, styles, voices, logos, brands, or reference materials that you do not have the right to use.
  • Impersonates another person, misleads viewers into believing generated content is real, or creates deceptive synthetic media.
  • Attempts to bypass safety systems, model restrictions, usage limits, credit limits, moderation, security measures, or access controls.
  • Scrapes, crawls, reverse engineers, overloads, disrupts, or interferes with the Service or related systems.
  • Uses the Service for spam, phishing, malware, fraud, political manipulation, or other unauthorized automated activity.

6. Intellectual Property Rights

6.1 Comik AI Materials

The Service, including our website, software, interface, features, workflows, designs, trademarks, logos, documentation, and other materials, is owned by Comik AI or its licensors and is protected by intellectual property and other laws. These Terms do not grant you any rights in Comik AI materials except the limited right to use the Service as permitted.

6.2 Your Content and Generated Outputs

You retain any rights you have in prompts, uploads, reference images, reference videos, character materials, and other content you submit. Subject to these Terms, you may use generated outputs you create with the Service. You grant Comik AI a limited, worldwide, non-exclusive license to host, store, process, transmit, display, reproduce, modify, and create outputs from your content as necessary to provide, secure, support, troubleshoot, and maintain the Service. We do not use your private content to train third-party AI models unless we separately disclose this or obtain your consent. You are solely responsible for ensuring that your inputs and your use of generated outputs do not violate any law or third-party right. We do not guarantee that generated outputs are unique, copyrightable, non-infringing, commercially usable, or suitable for any particular purpose.

6.3 Third-Party Content, Public Use, and IP Complaints

Third-party models, services, names, logos, characters, artworks, images, videos, brands, and other materials remain the property of their respective owners. Do not upload or generate content that infringes third-party rights. If you choose to publish, share, download, or commercially use generated outputs, you are responsible for obtaining all necessary rights and permissions. If you believe content on the Service infringes your intellectual property rights, contact support@comik.ai with sufficient information for us to review the claim.

7. Payment, Subscriptions, Credits, Cancellation, and No Refunds

Certain features require payment, credits, a subscription, or other paid entitlement.

  • All prices are listed in the currency shown at checkout, and payments are processed by third-party payment processors such as Stripe.
  • Subscriptions automatically renew unless cancelled before the next billing period.
  • You may cancel your subscription at any time from your account settings. After cancellation, your subscription remains active until the end of the current billing period, and you will not be charged for the next billing period.
  • All purchases, subscription fees, one-time credit packs, promotional offers, and credits are final and non-refundable, except where required by applicable law.
  • We do not provide refunds, partial refunds, prorated refunds, cash credits, or cash equivalents for unused time, unused credits, consumed credits, downgrades, mid-cycle cancellations, accidental purchases, dissatisfaction with outputs, failed prompts caused by user input, or discontinued use of the Service.
  • At our sole discretion, we may restore Service credits for certain verified technical failures, but any such restoration is not a cash refund and does not create an obligation to provide refunds or credits in other cases.
  • Credits are a limited, non-cash, non-transferable Service entitlement. Credits have no monetary value, cannot be redeemed for cash, and may expire according to the applicable plan, offer, or billing cycle.
  • If a payment fails, is disputed, reversed, refunded by a processor, or appears fraudulent, we may suspend or limit access to paid features, credits, generated assets, or the account.
  • We may change prices, plan features, credit costs, credit allocations, and promotional offers at any time. Changes will apply prospectively unless otherwise stated.

8. Disclaimers

8.1 'As Is' Basis

THE SERVICE IS PROVIDED ON AN 'AS IS' AND 'AS AVAILABLE' BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, SECURITY, OR ERROR-FREE OPERATION.

8.2 AI Output Disclaimer

AI-generated outputs may be inaccurate, incomplete, unexpected, offensive, similar to other content, low quality, unavailable, delayed, or unsuitable for your intended use. Comik AI does not guarantee that outputs will be unique, legally protectable, free from third-party claims, accepted by platforms, suitable for commercial use, or compliant with laws in your jurisdiction. You must review outputs before using, publishing, or distributing them.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COMIK AI, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, DATA, CONTENT, CREDITS, BUSINESS, OR OPPORTUNITY ARISING FROM OR RELATED TO THE SERVICE OR THESE TERMS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF USD $100 OR THE AMOUNT YOU PAID TO COMIK AI FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

10. Indemnification

You agree to defend, indemnify, and hold harmless Comik AI and its affiliates, officers, directors, employees, contractors, agents, licensors, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising from or related to your use of the Service, your prompts, uploads, reference materials, generated outputs, publishing, sharing, distribution, commercial use, account activity, payment disputes, violation of these Terms, violation of law, or violation of any third-party right.

11. Termination and Enforcement

We may reject prompts, refuse generation, remove content, restrict features, suspend credits, suspend or terminate accounts, or stop providing the Service if we believe you violated these Terms, created risk, abused the Service, infringed rights, failed to pay, or used the Service unlawfully. You may stop using the Service at any time and may cancel your subscription from account settings. Cancellation stops future billing but does not provide a refund for the current or previous billing periods.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located in Delaware, except where applicable law requires otherwise.

13. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and any additional terms presented for specific features, plans, promotions, or integrations, constitute the entire agreement between you and Comik AI regarding the Service.

15. Modifications to Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the 'Last updated' date. If changes are material, we may provide additional notice. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
